How Do Consumer Finance Laws Impact Financial Institutions?

Expanded on January 1, 2022, financial institutions such as payday lenders, debt collectors, or other alternative financial service providers must meet new oversight regulations as defined by the California Consumer Financial Protection Law (CCFPL). The purpose of the expansion is to hold accountable institutions that may use unfair, deceptive, or abusive practices to conduct business. By instituting these regulations, there is a push to keep those in this industry on a level playing field.

However, violating these regulations could result in significant penalties issued by the Department of Financial Protection and Innovation, or DFPI. For institutions that may violate these regulations, they could face any of the following:

  • Any institution in violation of the CCFPL could be penalized the greater amount of $5,000 per day they are in violation or fail to pay or $2,500 for any act of omission or violation
  • If a violation of the CCFPL is considered reckless, the penalty could be the greater amount of either $25,000 per day they are in violation or fail to pay or $10,000 for any act of omission or violation
  • If the violation of the CCFPL is intentional, the penalty could mean the greater of 1 percent of a person’s total assets, $1,000,000 for each day the violation is ongoing, or $25,000 for any act of omission or violation

This law does not change any current standing laws in California’s financial codes. In fact, the CCFPL encourages the institution of other penalties prior to their own imposition as a way to discourage violations.
